Terms and conditions

This is an English translation provided for convenience. In the event of any discrepancy, the Czech version prevails.

1. Introductory provisions

1.1. These general terms and conditions (the “GTC”) govern the contractual relationship between Bee Learning s.r.o., Company ID: 10827161, with its registered office at Střední 11, Brno, registered in the Commercial Register kept by the Regional Court in Brno (the “Provider”) and persons to whom the Provider provides educational services in the field of IT (the “Client”), in particular in the form of in-person and online training courses under a Service Agreement (the “Agreement”). These GTC form an integral part of the Agreement and of billing documents unless the Agreement expressly provides otherwise, and also constitute contractual terms within the meaning of Section 1751 of Act No. 89/2012 Coll., the Civil Code.

1.2. By concluding the Agreement, the Client confirms that they have read the wording of these GTC, including the personal data protection rules, accept them and agree to them, and will abide by their provisions.

2. Formation of the Agreement

2.1. The Agreement between the Client and the Provider is formed on the basis of an order placed via the registration form on the Provider’s website.

2.2. The Provider is obliged to confirm acceptance of the order to the Client within 5 working days of its receipt, to the e-mail address entered in the registration form. If the Provider fails to do so, the order is deemed not to have been accepted by the Provider. The Agreement is formed upon confirmation of the order.

3. Subject of performance

3.1. The subject of the Agreement is in-person or online teaching of IT knowledge in the relevant course announced by the Provider for the relevant period (the “teaching”).

3.2. The individual courses are specified on the Provider’s website beeit.cz

3.3. An order placed via the web form is binding. By submitting the order, the Client confirms that they have read and agree to these terms and conditions in the wording valid and effective at the time the order is submitted. The Client is bound by the terms and conditions from the moment the Agreement is concluded. The Client also has the opportunity to read these terms and conditions before submitting the binding order.

3.4. The Client agrees to the use of means of distance communication when concluding the Agreement. Costs incurred by the Client when using means of distance communication in connection with concluding the Agreement are borne by the Client. The use of means of distance communication for ordering courses is not subject to any special charge.

4. Organisation of teaching

4.1. Teaching takes place in person or online depending on the specific type of IT course, according to the course specification on the website beeit.cz

4.2. Teaching will take place in accordance with the schedule, the current version of which is available on the Provider’s website, unless agreed otherwise individually between the Provider and the Client.

4.3. The Provider reserves the right to cancel a course because the minimum course capacity has not been reached. In such a case the Provider is obliged to inform the Client of this fact no later than 5 working days before the start of teaching. If the Client has already paid the course price to the Provider, the Provider will refund the amount paid to the Client.

4.4. Courses, or individual lessons, are taught by the Provider’s qualified lecturers. The lecturer may change during the course or before it starts, to which the Client expressly consents.

4.5. If, for serious reasons, the Provider is unable to deliver the teaching, the Provider is entitled to choose an alternative way of delivering it.

4.6. For reasons of force majeure, the Provider has the right to move the date of teaching to another date or to offer the Client completion of an in-person course in the form of online teaching. In such a case the Client is not entitled to a refund of the course fee. For this purpose, force majeure means the impossibility of holding in-person and online teaching for reasons beyond the company’s control, in particular as a result of government regulations preventing or restricting the possibility of holding the course, an unfavourable epidemiological situation, a state of war, embargo, or natural disaster.

5. Price of teaching, payment terms

5.1. The price of the relevant course is specified in the Provider’s price list published on the Provider’s website in the Courses section. The course price is always stated including the statutory VAT rate.

5.2. Before the start of the course, the Client is obliged to pay the Provider the full course fee according to the current price list. By agreement with the Provider, the price may be split into instalments. In such a case the Provider is entitled to increase the price by 5 %.

5.3. The course fee may be paid in the following ways: by payment card online, by bank transfer, by benefit vouchers or via benefit systems.

  1. Payment card online – Payment can be made via the e-shop on the Provider’s website. After confirming the order, the Client will be redirected to an online payment gateway where the payment is made. When paying by card online, the Provider has no access to the Client’s bank details.
  2. Bank transfer – With this form of payment, the Client will be issued an advance invoice – tax document for the full amount of the order. The Client is obliged to observe the due date of the tax document. If the payer is a legal entity, the Client is obliged to state the Company ID and registered office of that legal entity.
  3. Benefit vouchers – The current list of accepted vouchers is published on the Provider’s website. When paying with these vouchers, none of the offered discounts can be applied.
  4. Benefit systems – The current list of accepted vouchers is published on the Provider’s website. The method of payment via these systems is governed by the terms of the individual intermediaries. When paying via these systems, none of the offered discounts can be applied.

6. Complaints, out-of-court settlement of complaints

6.1. If the Client is dissatisfied with the teaching, the Client is entitled to file a complaint with the Provider via the e-mail address info@beeit.cz. The Provider will confirm receipt within 10 days of delivery of the complaint.

6.2. The Provider will examine the stated grounds for the complaint and, in agreement with the Client, will in particular try to find an alternative solution, e.g. choice of another course, choice of another semester, refund of an appropriate part of the course fee (after deducting lessons already held), etc.

6.3. The Provider undertakes to decide on the complaint within 15 working days of its delivery. However, this period does not include the time needed for an expert assessment of the defect according to the type of course and the grounds for the complaint. In any case, the complaint must be settled without undue delay and no later than 30 days from delivery of the complaint to the Provider.

6.4. Obstacles arising on the Client’s side are not grounds for a complaint, in particular a change in the Client’s time availability, a change in the circumstances on the Client’s side under which they enrolled in the course, etc.

6.5. In the event of the Client’s current health problems lasting longer than 4 weeks, the Client is entitled to suspend the teaching and transfer an appropriate amount of teaching to a period in which the health problems have passed, where objectively possible. Health reasons must be proven by a medical report, in particular a certificate of incapacity for work, and this must be provided to the Provider as soon as possible, without undue delay, no later than 14 days after the suspension of the course; otherwise these reasons will not be taken into account.

6.6. If a consumer dispute arises between the Provider and the Client as a consumer that cannot be resolved by mutual agreement, the Client as a consumer is entitled to submit a proposal for out-of-court resolution of such a dispute to the designated body for out-of-court resolution of consumer disputes, which is the Czech Trade Inspection Authority (web: www.adr.coi.cz).

7. Withdrawal from the Agreement

7.1. The Client has the right to withdraw from the Agreement, even without giving a reason. In the event of withdrawal from the Agreement, the Client is entitled to a refund of:

  1. 65 % of the course price in the event of withdrawal at least 30 days before the start of the course
  2. 50 % of the course price in the event of withdrawal at least 15 days before the start of the course
  3. 10 % of the course price in the event of withdrawal less than 15 days before the start of the course

7.2. The Client is not entitled to a refund of the course fee in the event of withdrawal from the Agreement for a course that has already started.

7.3. A Client who is a consumer within the meaning of Act No. 89/2012 Coll., the Civil Code, has the right to withdraw from the agreement on the provision of IT courses within 14 days without giving a reason. This period begins on the day following the conclusion of the agreement. In such a case the Provider will refund all payments received to the Client within 14 days of delivery of a valid withdrawal, in the same way as the payments were received, unless the parties agree otherwise.

7.4. If performance of the subject of the agreement has already taken place within the first 14 days of concluding the agreement, and this was based on the order, the Client is obliged to pay a proportionate part of the course price corresponding to the teaching that has taken place.

7.5. The Client must send the withdrawal from the agreement to the Provider at the address stated in the header of the agreement on the provision of IT courses, always in writing, or by e-mail. The Provider undertakes to confirm receipt of the withdrawal within 3 working days.

7.6. The Provider has the right to withdraw from the Agreement with a Client who repeatedly, i.e. even after a written or verbal warning, violates the basic principles of civil coexistence, e.g. by verbal or written attacks on the lecturer or other course participants, publishing content inappropriate for teaching, etc. In the event of withdrawal from the Agreement for this reason, the Client is not entitled to a refund of the course fee or any other compensation. The Provider is also entitled to withdraw from the Agreement with a Client who is in any delay with payment of the course fee.

8. Personal data protection

8.1. The Client acknowledges that the Provider processes their personal data for the purpose of providing teaching in accordance with the legislation on the processing and protection of personal data, in particular, but not exclusively, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (GDPR), and any judicial or administrative interpretation of the legislation on the processing and protection of personal data, any guidelines, codes of conduct or approved certification mechanisms issued by the Office for Personal Data Protection (Personal Data Protection Regulations). Details of the processing of the Client’s personal data by the Company are set out here.

9. Final provisions

9.1. Should any provision of these GTC become invalid, ineffective or unenforceable or be in conflict with applicable legislation, it is deemed fully severable from the other articles of the document, and the other articles therefore remain in full force and effect.

9.2. The Provider is entitled to unilaterally propose changes to these GTC, in particular, but not exclusively, in response to changes in legislation. The Provider will inform the Client of the proposed change to these GTC at least 1 month in advance via its website or by e-mail, including information on the proposed effective date. If the Client does not reject the proposed change to the GTC in writing no later than the day before the proposed effective date, the Client is deemed to have accepted the proposed change to the GTC with effect from the date proposed by the Provider. If the Client rejects the proposed change to the GTC in writing, the original wording of the GTC remains in force. In such a case the Provider has the right to withdraw from the Agreement.

9.3. These general terms and conditions are binding on the Client in their entirety also where the services are provided or performed by a third party.
